Victor Pinzon appointed Arbitrator of the E-Global ADR Tribunal

    Washington, DC, January 17, 2000. Recognizing his extensive international business and other varied experience and accomplishments, including e-commerce, Victor Pinzon, the president of The Americas Foundation, an NGO think-tank based in Washington, DC, and president of La Casa de las Americas in Washington was recently invited and appointed Arbitrator of the E-Global ADR Tribunal.
    The E-Global ADR Tribunal, European based, specializes in the Arbitration and Conciliation of problems that may arise in transactions that use new technologies for their business operations, specially in business-to-business, business-to-consumer electronic commerce and cross border certification operations.
    Arbitration is a process whereby parties involved in a dispute present their cases to an impartial third party for the purpose of rendering a binding decision.
    Arbitration has become a preferred method of commercial dispute resolution all over the world. Beyond convenience and flexibility, it also offers certainty because arbitral awards can be enforced almost anywhere, thus avoiding the pitfalls associated with foreign judgments.
    In general, the following are some of the advantages of Arbitration:
- The Arbitration process is quick and simple
- The Arbitration costs are low
- The Arbitration allows the prevailing party to recover costs
- The Arbitration allows full specialization in one specific matter.
    Predictability also complements the other significant advantage of international arbitration, which is that international arbitral awards can be enforced almost anywhere in the world as virtually all trading nations are parties to the 1958 New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards. And more jurisdictions have been adopting the UNCITRAL Model Law.
    The E-Global ADR Tribunal is organized following the Rules and Models of 1996 of the United Nations Commission on International Trade Law (UNCITRAL), and as presented to the National Institute of Standards and Technologies (NIST) of the United States.
    The whole arbitral procedure is triggered when any of the two parties in a contractual relationship (importer, exporter, technology transferent, know how acquirer, etc..) is affected by full or partial breach of the contract.
    The affected party will be the Claimant and the other party in the contract will become the Respondent. At this moment, the E-Global ADR Tribunal will start operating, as the body that will act as the authority in charge of applying and coordinating all arbitration functions.
    An "Ad Hoc" Arbitral Tribunal is set up, made up by one or more arbitrators, selected by the parties, who will have to analyze the matters of law of fact that the parties claim, and through a rapid procedure the Arbitration Tribunal will make the Award or Ruling on the case.
